These Terms explain how HouseDiary works, what you can expect from us, and what we expect from you when you use our apps and website.

1. Who we are
These Terms of Service govern your use of the HouseDiary mobile apps, website, and related services, including myhousediary.com (together, the "Services"). HouseDiary is operated by FCExG, Inc., a Delaware corporation ("HouseDiary," "we," "us," or "our").
By creating an account, downloading the app, or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
2. Eligibility and accounts
You must be able to form a binding contract and comply with applicable law to use HouseDiary. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
Please provide accurate information and keep it current. If you believe your account has been compromised, contact us promptly at support@myhousediary.com.
3. What HouseDiary does
HouseDiary helps homeowners and property managers organize home information, including assets, schedules, vendors, service events, files, and maintenance history. Depending on your plan, the Services may also include AI-assisted parsing, home briefs, chat assistance, predictive maintenance tools, budgeting, recall monitoring, insurance or resale exports, and portfolio features.
We may add, change, or retire features over time. Some features may vary by platform, region, plan, or device capability.
4. Plans, billing, and auto-renewal
HouseDiary currently offers a Free tier and paid subscription tiers, including Resident, Pro, and Multi-Property plans. Pricing displayed in the app or at checkout controls at the time of purchase. Example current pricing includes Resident at $8.99 monthly or $89 yearly, Pro at $11.99 monthly or $99 yearly, and Multi-Property at $7.99 per property per month with a two-property minimum.
Paid subscriptions renew automatically unless canceled before the end of the current billing period. Subscriptions purchased through Apple App Store or Google Play are billed, managed, and canceled through your Apple or Google account settings. If we later offer direct web billing, the terms presented at checkout will apply to that purchase method.
5. Refund policy
If you subscribe through Apple App Store or Google Play, refunds are handled by Apple or Google under their policies, and we cannot issue or guarantee refunds for those purchases.
Except where required by law, paid fees are non-refundable and non-creditable once charged. Canceling stops future renewals but does not retroactively refund the current billing period.
6. AI features and important disclaimers
Some features use artificial intelligence provided through third-party AI services. AI features may analyze text, documents, images, metadata, and related home records that you submit in order to generate summaries, extraction results, answers, reminders, and recommendations.
AI output can be incomplete, inaccurate, or outdated. It is provided for general informational assistance only and is not a substitute for professional advice, contractor inspection, manufacturer guidance, insurance advice, legal advice, or official recall notices. You are responsible for reviewing AI-generated output before relying on it.
7. Acceptable use
You agree not to misuse the Services. For example, you may not: violate any law; infringe intellectual property or privacy rights; upload malicious code; attempt unauthorized access; interfere with the Services; scrape or reverse engineer the Services except where prohibited by law from restricting that activity; use the Services to harass, defraud, or harm others; or submit content you do not have the right to use.
We may suspend or terminate accounts that violate these Terms, create risk for other users, or threaten the integrity or security of the Services.
8. Your content
You retain ownership of the content you submit to HouseDiary, including home records, documents, photos, maintenance logs, and other materials ("User Content"). You give us a limited, non-exclusive, worldwide license to host, store, process, transmit, and display your User Content as needed to operate, secure, improve, and support the Services.
You represent that you have the rights necessary to provide your User Content and that our use of it as described in these Terms will not violate any law or third-party right.
9. Our intellectual property
The Services, including our software, branding, design, text, graphics, and underlying technology, are owned by HouseDiary or our licensors and are protected by intellectual property laws. These Terms do not give you ownership of the Services or our trademarks.
Subject to these Terms, we grant you a limited, revocable, non-transferable, non-exclusive right to use the Services for your personal or internal property-management use.
10. Availability and changes
We work to keep HouseDiary available and secure, but we do not guarantee uninterrupted or error-free operation. Maintenance, outages, bugs, third-party service failures, or platform restrictions may affect availability.
We may modify or discontinue features, impose usage limits, or update these Terms as the Services evolve. If we make material changes, we will post updated Terms and revise the effective date.
11. Termination
You may stop using the Services at any time. You may cancel auto-renewing subscriptions through the app store account used to purchase them. We may suspend or terminate access if you violate these Terms, if required by law, or if your use creates security, legal, or operational risk.
Sections that by their nature should survive termination, including ownership, disclaimers, liability limits, and dispute-related provisions, will survive.
12. Disclaimers
To the fullest extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Services will be accurate, reliable, secure, uninterrupted, or suitable for every use case, or that AI outputs, recall monitoring, maintenance recommendations, or budget insights will be complete or error-free.
13. Limitation of liability
To the fullest extent permitted by law, HouseDiary and its officers, directors, employees, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunity arising from or related to the Services.
To the fullest extent permitted by law, our total liability for all claims arising out of or relating to the Services will not exceed the greater of the amount you paid to HouseDiary for the Services in the twelve months before the claim arose or fifty U.S. dollars (US$50). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
14. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law rules, except to the extent superseded by applicable consumer protection law. You and HouseDiary agree to the exclusive jurisdiction of the state or federal courts located in Delaware for disputes not subject to mandatory arbitration or other non-waivable rights under applicable law.
